Terms of Service

v1.0 — July 2026 · DRAFT pending counsel review. This document reflects how StreetProof actually operates but has not yet been reviewed by Alberta counsel. It will be versioned; material changes require re-acceptance in the scout app.

1. Acceptance & scope

These terms govern use of the StreetProof website, public APIs, and the StreetProof Scout app (the “Services”), operated from Calgary, Alberta, Canada. Sections 6–12 (“Scout Terms”) additionally apply to anyone who creates a scout account. Scouts accept these terms and the Privacy Policy explicitly at signup; the accepted version is recorded, and using the Services after a versioned update requires re-acceptance.

2. Data licensing

  • Aggregate statistics (city/industry counts, Physical Presence Scores, study data marked as open) are licensed under CC BY 4.0 — use them freely with attribution to StreetProof.
  • The underlying observation ledger, evidence images, entity records, and per-observation data remain proprietary to StreetProof. No license is granted to reproduce, resell, or build derivative databases from them except via a written agreement or the API terms below.

3. API & machine access

  • Machine access is provided only through the documented public API and MCP endpoints (API docs).
  • API keys are personal to the holder, may not be shared or resold, and may be rate-limited, rotated, or revoked at StreetProof’s discretion.
  • Responses may be cached per the published cache headers; bulk redistribution of API responses is not permitted without a data agreement.

4. Acceptable use & no scraping

You may not scrape, crawl, or bulk-extract the Services beyond the public API; probe, overload, or bypass rate limits or authentication; attempt to re-identify blurred faces, plates, or fuzzed scout locations; or misrepresent StreetProof data as your own. We may block access that violates this section.

5. Verification holds

Submissions to StreetProof may be held for verification for any period before they are accepted, published, or credited. A submission that appears to process normally may still be under review. StreetProof has no obligation to publish, credit, or explain the handling of any individual submission.

6. Scout Program — eligibility

  • You must be at least 16 years old to hold a scout account.
  • You must have reached the age of majority in your province or territory (18 in Alberta) to receive cash payouts, paid tasks, or commissions; younger scouts may earn and redeem points only.
  • One account per person. Payout eligibility requires one verified payout identity per human; multi-accounting is a violation under Section 11.

7. Scout Program — capture rules

  • In-app camera only. Gallery imports, screenshots, edited images, and images produced or altered by other software are never eligible and their submission is a violation.
  • Capture only commercial branding visible from public space. Do not enter private property, photograph through windows into private spaces, or deliberately photograph people.
  • Capture metadata (GPS, heading, timestamps, device signals) must reflect a genuine physical capture. Interfering with it — mock location, injection tools, replayed imagery — is a violation.
  • Stay safe and lawful: no capturing while driving, no trespass, no harassment of business staff.

8. Scout Program — rights in submissions

You retain ownership of your photographs. In exchange for points eligibility, you grant StreetProof a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to host, reproduce, process, modify (including privacy blurring and cropping), create derivative works from, publish, and commercially exploit your submissions and their metadata as part of the StreetProof index and derived products. For submissions made under paid tasks, work product is assigned to StreetProof to the maximum extent permitted by law, and you waive moral rights in it to the extent permitted by Canadian law. You warrant each submission is your own genuine capture.

9. Scout Program — points & rewards

  • Points are a promotional program feature: they have no cash value, are not property, are non-transferable, and cannot be sold.
  • Point values, earning rules, streaks, multipliers, bounties, reward offers, and redemption rates are set dynamically and may change at any time without notice, including for existing balances.
  • Reward offers are fulfilled by participating businesses; StreetProof may substitute or withdraw offers. Points obtained through violations are void.
  • StreetProof may modify, suspend, or end the points program; where reasonably practicable we will provide a redemption window for existing balances.

10. Scout Program — paid tasks & payouts

  • Paid tasks are offered to eligible scouts as an independent contractor relationship — not employment, agency, or partnership. You control when and whether to accept tasks and are responsible for your own taxes; StreetProof issues tax slips where legally required.
  • Cash amounts (task payments, commissions, prizes) settle on a 14-day delay from being earned and are subject to clawback during and after that window where the underlying activity is found fraudulent, refunded, or in violation of these terms.
  • Payouts require a verified payout identity and a payout-eligible account standing.

11. Suspension & termination

StreetProof reserves the full right to suspend or terminate any account that our systems flag or our team confirms as violating these terms — including, without limitation: submission of fake, injected, AI-generated, or replayed imagery; GPS spoofing or mock location; emulator or tampered-device use; collusion to inflate any business’s score; multi-accounting or identity misrepresentation; redemption or commission fraud; and abuse of the API or app endpoints.

  • Suspension may be immediate and without prior notice. Detection may be automated; we are under no obligation to disclose detection methods, signals, or evidence.
  • Where fraud is confirmed, accrued points and pending (unsettled) payouts are forfeited; settled amounts obtained through fraud may be clawed back.
  • You may appeal via the trust & standing screen in the app or at [email protected]. Appeals receive a human review; the outcome is final.
  • Legitimate earned amounts unrelated to the violation will be settled per Section 10 unless obtained through the same fraudulent scheme.

12. Account deletion & ledger permanence

You can delete your account at any time from app settings; we offer a full export of your data first. Accepted observations already minted into the public ledger remain as anonymized records — the ledger is append-only and the records can no longer be traced to you after deletion. 13. Disclaimers & liability

The Services and data are provided “as is.” Presence scores are statistical observations, not endorsements or creditworthiness assessments. To the maximum extent permitted by law, StreetProof’s aggregate liability for any claim is limited to the greater of CAD $100 and amounts paid by you to StreetProof in the prior 12 months. Nothing here limits liability that cannot be limited under applicable consumer law.

14. Governing law & changes

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein; courts of Alberta have exclusive jurisdiction, subject to any non-waivable consumer rights in your home jurisdiction. We may update these terms; material changes are versioned and scouts must re-accept in-app before continuing to earn. Questions: [email protected].
